Terms & conditions

These Terms & Conditions apply to all quotations, works and services provided by Tom Child Landscapes Ltd (“TCL”). By accepting a quotation or instructing works to proceed, you agree to the terms outlined below.
1. Quotations & Payment Terms
All quotations are valid for 30 days from the date issued and include labour and materials unless otherwise stated.
Upon acceptance, payment terms are as follows:
A 10% booking deposit
Any agreed stage payments (where applicable)
The final balance payable within 7 days of completion
Payment details will be provided on your quotation or invoice.
2. Programme & Scheduling
TCL will always endeavour to commence and complete works within the agreed timescales. All dates are indicative and may be subject to change due to factors beyond our control, including weather conditions, material availability or unforeseen site conditions.
Payment of a deposit confirms your intent to proceed but does not guarantee a fixed start date.
3. Neighbouring Properties & Access
TCL will make reasonable efforts to minimise disruption to neighbouring properties during the course of the works.
Where access to neighbouring land, shared driveways or boundaries is required, it is the client’s responsibility to obtain any necessary permissions prior to works commencing. TCL cannot be held responsible for delays or additional costs arising from restricted access or neighbour disputes outside of our control.
4. Ownership of Materials
Ownership of all materials and goods supplied by TCL remains with TCL until payment has been received in full.
5. Payment Method
Payments must be made in full, without deduction, offset or counterclaim.
Payment is accepted via BACS transfer, unless otherwise agreed in writing.
6. Waste Removal & Skips
Where possible, TCL will arrange appropriate waste removal using registered skip or grab lorry services.
If it is not possible to place a skip at the property, waste will be securely bagged and removed at the earliest practical opportunity.
7. Quotations & Comparisons
We fully understand that clients may obtain multiple quotations. We recommend ensuring all quotations are based on a like-for-like specification, including comparable workmanship, experience and quality of materials.
8. Unforeseen Conditions & Variations
Projects are quoted based on visible site conditions at the time of quotation.
If unforeseen circumstances arise — such as underground concrete, pipework, drainage, cables or other obstructions — these will be discussed with you before works continue, along with any cost or programme implications.
TCL cannot accept liability for damage to existing services (including water, gas and electricity) unless their presence or location has been disclosed in advance and agreed as part of the scope of works.
9. Planning, Permissions & Boundaries
Unless otherwise agreed in writing, the client is responsible for ensuring that all necessary planning permissions, approvals and consents are in place before works commence.
TCL works based on boundary positions and site information provided by the client and cannot accept responsibility for boundary disputes or inaccuracies unless boundaries have been formally confirmed in advance.
10. Waste Disposal Responsibility
Under current legislation, the property owner retains legal responsibility for how waste is disposed of from their property.
TCL will remove and dispose of all waste generated by the works in accordance with relevant regulations, using licensed carriers and approved disposal facilities.
11. Insurance, Welfare & Site Care
Tom Child Landscapes Ltd is fully insured and operates in line with industry best practice for health, safety and site welfare.
We take care to protect your property during the works and will leave the site clean, safe and tidy, with all agreed waste removed upon completion.
12. Photography, Privacy & Location
TCL may photograph completed works and reference elements of a project — such as materials, layouts or design features — for portfolio, website, social media or other marketing purposes.
We take client privacy seriously. Any imagery or project information used will focus on the landscaping work itself and will not include personal details, full addresses or identifying information. Locations will be referenced in general terms only (for example, town or area rather than a specific address), unless otherwise agreed.
If you have any concerns or specific restrictions regarding photography, project details or location references, please let us know in advance and we will accommodate where reasonably possible.
